Yes.
No.  Its semi-decriminalized in several states meaning you can't go to jail for it (in small amounts) but they can give you a ticket for posession and possibly make you take a stupid class on it.

Good point--not to mention the several states (something like 13) that have medical exemptions for it so that it's not even an infraction (a citation with a fine, etc.) for patients.

Hansen said the United States. As far as I know, the United States represents the United States Federal government...and believe me, they don't give a shit what the states have decriminalized.
