an unarmed man whom he hogtied, Tasered and beat, a federal judge ruled Friday.
     The 51-month sentence comes over a year after a federal jury convicted Karl Thompson Jr. of excessive force and lying in the ensuing investigation.
     Thompson had confronted Otto Zehm on March 18, 2006, while responding to an ultimately false report involving a suspicious character at an ATM.
     Zehm, 36, had gone to a convenience store to buy soda and snacks. Security cameras captured an ensuing struggle he had with the officer in which Thompson beat Zehm with a baton and Tasered him repeatedly.
     Other officers then rushed in, tied up Zehm, placed a plastic mask over his face and sat on him until he stopped breathing, evidence showed. Zehm died a few days later.
     Evidence showed that Thompson never asked Zehm any questions or even mentioned the ATM. Witnesses testified that Zehm's last words were: "all I wanted was a Snickers."
     The Spokane County medical examiner ruled Zem's death a homicide, but local prosecutors refused to file charges against Thompson. The FBI eventually investigated the case and filed charges against Thompson for using unreasonable force and making a false statement.
     Thompson claimed the beating was justified because he felt threatened by a plastic bottle of soda Zehm was holding. In his initial report, delivered after knowing Zehm had died, Thompson denied hitting Zehm in the head with his baton.
     He said he would not have done that because such an action would have constituted unjustifiable deadly force.
     Trial testimony established that Thompson admitted to another officer on-scene the night of the altercation that he had struck Zehm in the head and neck with his baton.
     Witnesses and medical testimony also confirmed that the defendant had delivered baton blows to Zehm's head and neck.
     U.S. District Judge Fred Van Sickle handed down the sentence from Spokane. Thompson was tried in Yakima over publicity concerns.
     Justice Department attorney Victor Boutros prosecuted the case along with Assistant U.S. Attorneys Timothy Durkin and Aine Ahmed of the Eastern District of Washington.

Two off-duty Florida police officers have shot and killed a naked woman who confronted them at a party. Officers say the woman was armed, without disclosing what type of “weapon”, whether alcohol was involved or were the guns their service weapons.
Authorities say the shooting occurred at 1:15 pm Saturday in a house north of Tampa in rural Spring Hill, Florida. The off-duty officers were allegedly approached by what they said was an “armed, naked and irrational female,” according to a Hernando County news release. The woman had not been invited to the party and no one knew why she was naked. A partygoer called 911 to report the nude woman, who until then had refused to leave the party.
The woman then appeared to leave, but came back shortly thereafter, allegedly carrying a weapon. The officers then opened fire on her.
The news release provided detailed information about the course of events, but has no information on the alleged weapon the woman was carrying.
The officers, 26-year-old William Mechler and 31-year-old Rocky Howard, were off duty, but still carrying their firearms at the party. According to Hernando County Sheriff Al Neinhuis, “one or both of the law enforcement officers fired their weapons, striking the female” because she was “acting irrational.”
“It was obvious being naked she was not in her right mind,” Neinhuis told Fox 13 News.
The woman died from her injuries at the scene.
The county sheriff’s department encourages officers to be armed 24/7, even while off-duty. Authorities have refused to comment on whether the firearms used by Mechler and Howard were personal weapons or service handguns.
According to Fox, police have not yet identified the woman.
A lot of questions surrounding the incident remain unanswered. Reporters from Tampa Bay Times tried to reach property owners of the house where the party was held, as well as Howard, but received no responses. Mechler refused to comment.
The two officers, who are believed to be friends, have been placed on paid administrative leave pending an investigation by the Florida Department of Law Enforcement.
The shooting comes two weeks after the University of South Alabama campus police fatally shot a naked, unarmed student who was pounding on the glass door of the police station. Authorities claimed 18-year-old Gil Collar was high on LSD and tried to attack an officer. But an attorney defending the deceased student says Collar never touched the officer. A surveillance video of the fatal shooting shows the student with his arms outstretched and palms open seconds before being shot.
“I have seen nothing to indicate to me that you ought to go out there with a raised gun against a guy who’s buck naked, unarmed and in distress,” attorney Jere Beasley told the Associated Press

Edward Krawetz, the Lincoln police officer convicted of kicking a handcuffed woman in the head outside Twin River casino in 2009, will serve no jail time.

Superior Court Judge Edward Clifton Monday sentenced Krawetz to a 10-year suspended ACI sentence and 10 years' probation. The state had asked for seven years with 18 months to serve behind bars.  Krawetz could have faced up to 20-years in jail.  The judge also ordered that Krawetz have no contact with the victim and to undergo mental health counseling.

In imposing a sentence of less than jail, the judge said he had explored the possibility of home confinement, but said a statute bars such a sentence in cases involving crimes of violence.  The judge also cited a 2007 incident which led Krawetz to briefly seek out psychological counseling.  He would not disclose details of the incident, saying accounts of it remain under seal.

Attorney General Peter Kilmartin issued a statement following the sentencing, and said that the actions of Krawetz must not reflect poorly on other police officers.

“I know firsthand the duty of a sworn police officer; to serve the public and uphold the law.  When a police officer or other public official engages in criminal conduct, dishonesty, or an abuse of power, the public trust is seriously undermined.  Once that trust is broken, it is difficult, if not impossible, for police officers to do their jobs.  The inexcusable actions by Edward Krawetz should not and must not reflect the actions by the thousands of police officers who perform their duties each day with pride, integrity, honesty and within the legal and ethical boundaries of the law,” said Kilmartin in a statement.

In January, Krawetz was found guilty of felony battery with a dangerous weapon stemming from the 2009 incident.  The incident was captured on film by a surveillance camera which showed Krawetz exchanging kicks with a handcuffed Donna Levesque outside Twin River Casino. In the video Levesque tries to kick Krawetz’s shin and Krawetz responds by kicking her in the head. Levesque was being removed from Twin River by police for disorderly conduct.

During the trial, Krawetz maintained that he only kicked Levesque out of self-defense. Krawetz waived his right to trial by jury therefore the case was heard only before a judge.

This was not Krawetz’s first incident; in 2001 Krawetz got into an altercation with a man on the Cumberland bike path and was convicted of assault. As a result, he was suspended from the police department for 30 days.
