Oral argument for this case took place at the NH Supreme Court in
Concord, NH, this morning.  Judging by how the justices behaved, it
looks certain that they'll be striking down the DMV's regulation as
unconstitutional.

The court room was chocked full of reporters and other spectators.  You
can expect to see coverage of this on WBZ and WMUR, tonight, as well as
just about every newspaper imaginable tomorrow.  I was amazed to see
just how much interest this case has generated.

the justices interrupting the litigants!), a video recording of it

General / NH Supreme Court: COPSLIE vanity plate case update

Update:

The NH Supreme Court has scheduled this case for oral argument this
Thursday, November 7, 2013.  The court will be giving me 5 minutes to
make my case.  They're giving the Attorney General's office 15 minutes.
Amicus curiae New Hampshire Civil Liberties Union will be getting 10
minutes.

Portsmouth Herald on Sunday, October 13, 2013:

Oral argument will be at the NH Supreme Court at 1 Charles Doe Dr. (just
off of Hazen Dr.) in Concord, NH 03301, during the morning session...
which essentially means whenever the court wants, between 9:00 A.M. and
12:00 noon.  The official oral argument schedule can be found on the
Supreme Court's Web site:

Oral argument should also be webcast live via the court's streaming

As always, proceedings in court are "free" and open to the public (for

Jury trial for this supposed "Disorderly Conduct" is scheduled for this Tuesday, June 29, 2010 at 10:00 A.M. in Strafford Inferi Superior Court at 259 County Farm Road, Dover, N.H (right across the street from the county jail).  The trial will probably be held in courtroom #1.

The state is planning on paying for a bus (no joke!) to take the jurors downtown, Wednesday morning, to see the sidewalk where the incident occurred.  So the jury should be returning their "not guilty" verdict sometime Wednesday.   :)

Anyone who wishes to come and watch all or part of the festivities is welcome to.

Coincidentally, at 9:00 A.M. in the same court, a Farmington cop will be getting arraigned for stealing from his police department's evidence room.  That arraignment will probably be held in courtroom #2, just down the hall.

Well, the court agreed to postpone the trial, and they've scheduled a status conference for October 1 @ 09:00.

They can do that? 

Well, they tried to.  I filed a motion to continue and motion for counsel with the court this afternoon.

General / URGENT CALL FOR HELP - Liberty-minded lawyer needed!

As many of you know, for the past year or so, I have been spearheading the Seacoast Liberty Police Anti-corruption Campaign (SEALPAC).

This morning, at a hearing in Strafford County Superior Court, the court discharged the public defender representing me, and told me that I have until the day after tomorrow (Wed. 9/23) at 11:00 A.M. to find a new attorney!

If I don't get an attorney to file an appearance by Wed., they are going to force me to present my case pro se.  That is, without a lawyer.  Needless to say, I will probably loose.  If, however, I can get an attorney to at least file an appearance by 11:00 Wednesday morning, they will postpone the trial to give the new lawyer some time to become familiar with the case.

The charge in this case is for supposedly "resisting" arrest.  Of course, the charge is completely fraudulent.  (You may know me as the guy who was arrested while trying to use a crosswalk in Dover. Details at free-smiley.org.)

If anyone knows of liberty-minded lawyers who might be able to help, PLEASE have them call or e-mail me ASAP!

Any leads, ideas, suggestions, or referrals would be much appreciated!

Is Mr. Montenegro defending himself pro se or does he have counsel?  I'm glad to hear that he was using the court's discovery rules. 

I will be representing myself during the circus trial tomorrow.

You might be surprised how few people utilize (or even know about) discovery.  When I filed my first subpoena with Dover District Court, the clerks were confused how to process it.  Clearly, there aren't many people exercising their sixth amendment rights here.

The trial for this supposed "Disorderly Conduct" is scheduled for this Thursday, May 21, 2009 at 10:00 A.M. in Dover District Court at 25 Saint Thomas Street, Dover, N.H.

Anyone who wishes to come and watch is welcome to.  I have an overwhelming body of evidence to show that this was a purely political arrest.  Not surprisingly, the prosecutor is doing everything he can to bog down discovery.  I suspect, somewhere deep down inside, he knows this case will show the true color of the Dover police.

It should be interesting...

Who we are...

The Seacoast Liberty Police Anti-corruption Campaign (SEAL PAC) is a group of civil rights activists working to eliminate abuses of police power in the Seacoast and, in particular, within the city of Dover.

SEAL PAC aims to document and publicize corrupt practices in law enforcement, to negotiate with city officials to stop abusive practices, and to seek compensation for victims of police misconduct.

SEAL PAC provides a safe place for victims of police misconduct to connect with fellow victims, and to learn about options available to them. Through SEAL PAC and its legal team, citizens will have the collective bargaining power needed to take back their civil rights and--as the SEAL PAC slogan goes--"bring justice back to law enforcement."

Seacoast Liberty Police Anti-Corruption Campaign

November 29, 2008

David Montenegro, founder of the Seacoast Liberty Police Anti-Corruption Campaign (abbreviated "SEAL PAC"), got arrested today while hosting an information table in downtown Dover. This event was intended to raise awareness about a growing problem in the city of Dover: civil rights violations committed by the city's police department. It may come as no surprise, then, that the police found a reason to arrest Mr. Montenegro.

Mr. Montenegro had applied for, and received, a permit from the city to hold the event on November 29, 2008, from 11:00 A.M. to 1:00 P.M., with November 30, 2008 as a designated rain date. Mr. Montenegro was charged with disorderly conduct and released on $1,500.00 personal recognizance bail.

December 6, 2008

Supporters of the Seacoast Liberty Police Anti-Corruption Campaign (SEAL PAC) gathered in downtown Dover, today, to protest last week's arrest of David Montenegro, and raise awareness about other abuses of police power in Dover. Six of us braved the December chill to gather on the corner of First St. and Central Ave., from 11:00 A.M. to 1:00 P.M. today.

During this two-hour period, we demonstrated our rights to free speech and peaceful assembly, and received four new complaints alleging misconduct on the part of Dover police. These four complaints come in addition to about two dozen already received, and are typical for a two-hour event. On average, we receive about three complaints for every hour spent talking with the public.



This was also the first of our exhibits not to be visited by local law enforcement. Officers from the Dover police department have shown up at all of SEAL PAC's prior displays; however, not a single uniformed officer appeared at today's event. Today, we demonstrated very clearly that we will not be intimidated or illegally censored.

I, personally, am glad that so many people decided to speak out about this problem. It takes no small amount of bravery to critique the police in a public setting. My thanks go to everyone who came out today for the courage and principle they demonstrated.

SEAL PAC's next gathering will be on Saturday, December 13, 2008, at the same time and in the same location. In case of rain or snow, the event will be held at the same time on the following day.
