Knock Knock: A Legal Defense Guide

Interesting excerpt:

Quote
Usually the course of events is as follows.  You will receive a letter from the FCC taking notice of your operation.Sometimes the letter will be presented as part of their visit to your station.  This letter will state that if your persist inunlicensed operations you will be subject to possible fines or jail.  In order to either collect a fine or begin criminalproceedings the FCC has to present their case to a Federal court.  Despite fines being assessed against a number ofpeople they have yet to go to court in order to collect the fines since this would open their process to possible Consti-tutional scrutiny.  Likewise for the criminal proceedings as well.  So far there have only been only  one or two instancesof actual criminal prosecution.

Pirate stations spread throughout NH and run by liberty activists could be a real headache for the FCC...

Anyone know if pirates have ever been raided without notices sent first?

Here's another story about a longtime CA pirate:

Friend got a letter telling him to stop. It wasn't addressed to him, just a form letter to the resident.
He moved his operation down the street during the night.

Those are NOT the "REAL" rules of Part 15. That publication is merely a reference bulletin written primarily for the general public's understanding of the use of non-licensed wireless devices.

Here is a quote from that bulletin that validates what I just said.

This bulletin is intended to provide a general understanding of the FCC's regulations and policies
applying to products using low-power transmitters. It reflects the current text and interpretations of
the FCC's regulations. More detailed information is contained in the regulations themselves, which
can be found in Part 15 of Title 47 of the Code of Federal Regulations. [/b]This bulletin does not replace
or supersede those regulations.[/b]

The actual Part 15 rules can be found at http://www.fcc.gov/oet/info/rules/ and then follow the Federal Register link.

Happy Hunting! 8)

After reading the story of Pirate radio, i am impressed by the continuous fighting for the micropower air broadcast. It is no doubt the basic rights for personal radio station. www.hcfmtv.com
